Terms of purchase
1. Terms of purchase:
1.1. These Purchase Conditions apply to the legal relations arising between the customers of the JoieSport store and the owner of the store JoieSport OÜ when purchasing goods.
1.2. If any clause of the Purchase Conditions is in conflict with the laws of the Republic of Estonia, the laws of the Republic of Estonia shall prevail.
1.3. In addition to the Purchase Conditions, the relations between the Customer and the Customer are regulated by the Good Practices established in the Republic of Estonia.
1.4. JoieSport reserves the right to unilaterally change these Terms of Purchase and product prices due to changes in legislation or the business environment. Changes to the terms of purchase will take effect as of the publication of this information on Icestar's website www.joiesport.ee. If the Customer submitted his order before the amendments to the Purchase Conditions came into force, the conditions valid at the time of sending the order shall apply to the Customer, unless otherwise provided by law. We recommend printing out the Purchase Conditions during the ordering process.
1.5. By placing an order, the Customer confirms that he has read the Purchase Conditions and agrees with them.
2. Prices of goods:
2.1. The prices of the goods sold by JoieSport are given in euros, but do not include the delivery fee. JoieSport reserves the right to change the prices of the goods according to how the purchase prices change. If the Customer submitted his order before changing the price, the price indicated in the order confirmation applies to him.
2.2. Delivery of the goods pays depending on the method of delivery chosen by the Customer.
2.4. JoieSport reserves the right to adjust prices. If the Customer submitted his order before the price change took effect, the price of the goods before the change took effect applies to him.
3. Shopping cart and ordering:
3.1. The Customer's Shopping Cart is created the moment he / she clicks on the "Add to Cart" button on the product page.
3.2. The Customer can change the quantity of products in the Shopping Cart and remove them from the Shopping Cart if necessary.
3.3. The products in the shopping cart are also available to other Customers until the order is confirmed.
3.4. When placing an order, the Customer chooses the delivery method he / she likes and checks whether the Recipient's data is correct.
3.5. After confirming the purchase, it will be sent to the Customer by e-mail.
3.6. The purchase and sale agreement is considered concluded if the Customer has paid for the order in the amount of 100%.
4. Payment for the ordered goods:
4.1. It is possible to pay for the ordered goods with a credit card.
4.2. After completing the purchase, the invoice will be sent to the Customer's e-mail.
4.3. If the Customer has not received an invoice, please contact JoieSport OÜ by phone or e-mail.
4.4. If the Client wishes to pay by invoice and a longer payment term, please contact firstname.lastname@example.org.
4.5. If the Customer has not paid for the order within 3 calendar days from the date indicated on the invoice, JoieSport considers this to be the Customer's wish to cancel the purchase and cancels the order.
5. Delivery of goods:
5.1. After paying for the order, the goods will be delivered to the Customer within 1-14 days.
5.2. It is also possible to pick up the goods yourself in our stores in Tallinn, Punane tn 52.
5.3. If agreed in advance, we will also send the goods by Cargobuss.
6. JoieSport uses the personal data provided by the Customer only to fulfill the Customer's purchase order. JoieSport does not disclose information obtained during purchases to third parties, except for partners who deliver the goods.
In matters not regulated in these terms and conditions, the Client and JoieSport OÜ shall be guided by the laws and government regulations in force in the Republic of Estonia.
Disagreements and disputes arising from the fulfillment of these conditions shall be settled by the parties primarily through negotiations. If disputes arising from the Agreement cannot be resolved through negotiations between the parties, both the Customer and JoieSport have the right to apply to the Consumer Protection Board or a court to protect their rights.
6.1. If the goods do not fit or do not meet the Customer's expectations, the Customer has the right to return them within 14 days of receiving the goods. JoieSport must be notified of the return of the goods before posting by sending information by e-mail to email@example.com.
6.2. The customer has the right to return the goods made to special order and delivered under special conditions only by prior written agreement with Joiesport.
6.3. The returned goods must be unused, with the original labels and in the original packaging.
6.4. The money for the returned goods will be returned to the Customer's bank account as soon as possible, but not later than within 14 days from the receipt of the notice of withdrawal from JoieSport.
6.5. JoieSport does not reimburse the cost of returning the goods to the Customer.
6.6. If it is seen and the examination establishes that the returned product has been used or damaged and has been caused by the Customer, the product will not be refunded and JoieSport will return the product to the Customer.
7. Deadline for submitting a claim and return of non-compliant products:
7.1. Pursuant to § 218 (2) of the Law of Obligations Act, the Customer has the right to file a claim within two years from the receipt of the goods. A defect that occurs during the first six months is presumed to have existed at the time of purchase of the product and the nature of the defect must be determined by the seller.
7.2. If the defect is of a technological nature, the Customer may request the product to be repaired and, in the event of impossibility or ineffectiveness of the repair, the product to be replaced. A refund can be demanded if replacement within a reasonable time has not proved possible due to the lack of a suitable product (VÕS, Chapter 11, Section 222, Subsection 1).
7.3. In the event of an unexpected defect, the Customer must send an e-mail to firstname.lastname@example.org with the following information:
7.3.1. Customer name and contact details;
7.3.2. the date on which the complaint was lodged;
7.3.3. date of order;
7.3.4. a defect in the product, if possible, include photos;
7.3.5. Claim to JoieSport;
7.3.6. order number, if possible attach a copy of the order confirmation.
7.4. This statement must be sent no later than 14 days after receipt of the product after the defect has occurred. If the specified term is not observed without good reason, the Customer loses the right to request JoieSport to repair the product or replace the part free of charge.
7.5. JoieSport is not responsible for:
7.5.1. Damage to the product due to the customer's fault or negligence;
7.5.2. defects caused by improper use of the product;
7.5.3. natural physical wear and tear of the product during normal use.
8. Liability and force majeure:
8.1. JoieSport is liable to the Client for the damage caused by JoieSport by violating these terms and conditions in the cases and to the extent provided by the legislation in force in the Republic of Estonia.
8.2. The Client shall be liable to JoieSport for the damage caused by the Client by violating these terms and conditions in the cases and to the extent provided by the legislation in force in the Republic of Estonia.
8.3. Neither party shall be liable to the other party and its conduct shall not be considered a breach of these terms due to delay or failure to perform any of its obligations unless the reason for such delay or failure was beyond the control of that party (force majeure).
8.4. JoieSport does not compensate for the moral damage that may be caused to the Customer by changing the delivery times, prices and other conditions within the framework of these terms. If the product is purchased as a birthday present or for any other reason it is very fast to receive the product, please write to us immediately after placing the order.
